Since 2009 the U.S. Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs (OFCCP) of the U.S. Department of Labor have embarked on ambitious compliance and regulatory agendas. As the number of discrimination charges has increased, so have the number of investigations closed by the EEOC and compliance reviews and administrative complaints initiated by the OFCCP. The agencies' regulatory agendas have been equally ambitious, culminating in the OFCCP's recent publication of proposed regulations and goals for individuals with disabilities. This webinar will provide an update regarding the compliance and enforcement activities of the EEOC and the Department of Labor/OFCCP and will offer compliance tips and best practices for employers and EEO professionals.

Julia Mendez, CAAP, PHR, CELS
Julia Méndez is Principal Business Consultant for the Workforce Compliance and Diversity Solutions division of Peoplefluent’s New Orleans office. Ms. Méndez’s current duties include overseeing the training programs for customers as well as creating content and delivering training in areas such as equal employment opportunity (EEO) and affirmative action (AA) compliance, EEO-1, VETS-100A, web accessibility for persons with disabilities, and reviewing responsibilities of AA and EEO to management. She also has 16 years experience in assisting clients through OFCCP compliance reviews, and offering technical assistance both to clients and internal customers. Her duties also include overseeing the New EEOSource website and publication and also serves as the Diversity Chairperson for the Workforce Compliance and Diversity Solutions. She has also been invited to speak at national, regional and local conferences on topics such as new veteran classifications, EEO-1 and VETS-100A requirements, web accessibility for persons with disabilities, preparing for an OFCCP compliance review, and EEO/Affirmative Action/Diversity legal requirements.
Ms. Méndez is a graduate of University of New Orleans where she obtained a Bachelor of Science degree in General Business Administration and a Master of Business Administration. She also holds a Professional in Human Resources certification from the Society of Human Resource Management since 1998, is a Certified Employment Law Specialist from Columbia Southern University, and is a Certified Affirmative Action Professional from the American Association for Affirmative Action.

Title VI Compliance for Colleges and Universities
Colleges and universities who are recipients of federal financial assistance must comply with many federal equal opportunity (EO) statutes including Title VI of the Civil Rights Act of 1964. Title VI prohibits discrimination on the basis of race, color and national origin by recipients of federal financial assistance. This law and its accompanying regulations are enforced by federal agencies that award grants of assistance, including the U.S. Department of Education’s Office for Civil Rights.
The webinar will cover the panoply of issues that colleges and universities must address in order to be in compliance with Title VI, beginning with an overview of the statute, coverage, the breadth of issues included from admissions to athletics, types of adverse actions, and complaint investigations. Hostile environment and bullying as matters prohibited by Title VI will also be addressed. In addition the webinar will cover preventative measures and responsibilities of faculty, staff and students.

Seena Foster, J.D.
Seena Foster received her Juris Doctorate from The George Washington University Law School. She is a Partner of Title VI Consulting, LLP in Alexandria, Virginia and is the author of Civil Rights Investigations Under the Workforce Investment Act and Other Title VI-Related Laws: From Intake to Final Determination. Her book was judged by a panel of industry experts as a Finalist in the 2011 USA Best Books Awards, sponsored by USA Book News.With a passion for ensuring nondiscrimination and equal opportunity, she offers guidance related to compliance with Title VI-related laws through training and resource development. In 2007, Ms. Foster was certified as a mediator by the Virginia Supreme Court and later obtained "Federal Workplace Mediation" certification through the Northern Virginia Mediation Service. Presently, she volunteers at Carpenter's Shelter in Alexandria, Virginia and serves on its Development Committee. In addition, Ms. Foster serves on the Economic Opportunities Commission for Alexandria, Virginia, which addresses availability of housing and jobs for economically disadvantaged persons. And, she is a member of the Discrimination Law and Human Rights Law Committees of the International Bar Association. Finally, in November 2011, Ms. Foster was selected as a lifetime member of the Cambridge Who's Who among Executives, Professionals, and Entrepreneurs based on her accomplishments, talents, and knowledge in the area of civil rights (see www.seenafoster.com).
